DB Symmetry Planning Application update 27.1.19

The original application KET/2017/0616 was refused by Kettering Borough Council and DB Symmetry Ltd are now appealing that decision. DB Symmetry have also submitted a new improved application KET/2018/0965.

DB Symmetry Ltd are appealing to the Planning Inspectorate (PINS), this appeal is scheduled to be heard by Public Inquiry for 6 days in May 2019. Kettering Borough Council (KBC) engaged a planning barrister and also instructed an independent transport consultant to assist in defending the appeal. Following a review of the appeal case, the planning barrister has advised the KBC it has no prospects whatsoever of successfully defending the appeal. In addition if the Council continues to defend the reason for refusal, KBC might have a full award of costs made against KBC if it loses the appeal. KBC have decided and notified the Planning Inspectorate it will not to present any evidence at this appeal hearing. More »

Therefore the Public Inquiry will proceed and will be determined by the Planning Inspector alone.

Pytchley Parish Council has written a letter of objection for the KBC decision not to present evidence to the inquiry, and asks for the matter to go back to the Planning Committee, the letter also requested an extension to the deadline for commenting on the new application, the extension date is now February 9th 2019 to send comments to the Local Planning Authority regarding the new planning application.
